Donation Program

By participating in the 2016 America’s Better Sandwich Donation Program (the “Program”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Program Dates & Overview: Program starts at 12:00 p.m. Eastern Time (“ET”) on 6/15/16 and ends at 12:00 p.m. ET on 10/23/16 (“Program Period”), or when the maximum donation (described below) has been reached, whichever is sooner (“Program Period”). Bimbo Bakeries USA, Inc. (“BBU”) will donate one (1) loaf of bread to Feeding America for each entry and vote received in the America’s Better Sandwich Contest (the “Contest”), with a minimum of 75,000 and up to a maximum of 100,000 loaves donated throughout the Program Period. How to Participate: During the Program Period, visit https://www.americasbettersandwich.com and follow the directions provided to submit an entry or vote for a posted entry in the Contest. BBU will donate one (1) loaf of bread to Feeding America for each Contest entry and/or vote received in the Contest, with a minimum donation of 75,000 and up to a maximum of 100,000 loaves donated throughout the Program Period. Exact loaves of bread provided (Brownberry, Oroweat or Arnold sliced bread) will be determined by BBU in its sole discretion based on the  location of delivery to Feeding America. Information concerning Feeding America, including financial, licensing or charitable purpose may be obtained, without cost, by visiting feedingamerica.org

General Conditions: BBU, BBU, Coyne PR, Trymark Consulting Group, L.L.C., Feeding America and their respective parent companies, affiliates, subsidiaries and advertising and promotion agencies and (collectively, the “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, or delayed Contest entries or votes, availability or accessibility or miscommunications or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or other errors or problems of any kind. Should any portion of the offer be, in BBU’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of BBU, corrupt or impair the administration, security, fairness or submission of information, BBU reserves the right at its sole discretion to terminate the Program. By participating, you agree to be bound by these Terms and Conditions and the decisions of BBU which are final and binding. 

Disputes: Except where prohibited, participant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Pennsylvania; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program, and in no event shall participant be entitled to receive attorneys’ fees or other legal costs or expenses; and (c) Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, participant’s rights and obligations, or the rights and obligations of BBU in connection with the Program, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania.
